JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.5 in Crime No.8/2025 registered by Kanakapura Police Station, Ramanagar, for the offences punishable under Sections 126(2), 115(2), 351(3) and 308(5) of the Bharatiya Nyaya Sanhitha, 2023 (hereinafter referred to as 'BNS, 2023' for short) is before this Court in this criminal petition filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking anticipatory bail.
2. Heard the learned counsel for the petitioner and the learned HCGP for the respondent/State.

3. FIR in Crime No.8/2025 was registered by Kanakapura Police Station, Ramanagar, initially for the offence punishable under Section 308(5) of BNS, 2023 against Durgachandra and others, based on the first information dated 19.01.2025 received from Prajwal. Apprehending arrest in the said case, petitioner who is arraigned as accused No. 5 in the FIR had filed Crl. Misc. No. 5166/2025 which was rejected by the jurisdictional Sessions Court on 21.06.2025. Therefore, petitioner is before this Court.
4. Perusal of the material on record would go to show that the alleged victim and the accused persons are all acquainted with each other. Petitioner aged about 57 years, is said to be an agriculturist by avocation. He has no other criminal antecedents. The maximum punishment for the alleged offences is imprisonment for a period of 7 years and the alleged offences are triable by the Court of Magistrate. Accused no. 2 who was arrested in the present case has been granted regular bail by the jurisdictional

5. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following:
ORDER The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of her arrest in Crime No.8/2025 registered by Kanakapura Police Station, Ramanagar, for the offences punishable under Sections 126(2), 115(2), 351(3) and 308(5) of the Bharatiya Nyaya Sanhitha, 2023, subject to the following conditions: a. The petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal

HC-KAR NC: 2026:KHC:28765 CRL.P No. 16743 of 2025 bond for a sum of Rs.1,00,000/- (One lakh only) with one surety for the likesum to the satisfaction of the investigating officer. b. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. c. Petitioner shall not tamper with the prosecution witness and he shall co- operate with the police for investigation and appear before them whenever called upon. d.
