$~97 * IN THE HIGH COURT OF DELHI AT NEW DELHI # CNR No. DLHC010467542026 + CRL.M.C. 7286/2026 ANIL KUMAR .....Petitioner Through: Mr. Amar Nath Gautam, Mr. Pankaj Kumar and Mr. Subhash Singh Yadav, Advocates. versus STATE (GOVT OF NCT OF DELHI) & ANR. .....Respondents Through: Mr. Shoaib Haider, APP for State. CORAM: HON'BLE MR. JUSTICE SANJEEV NARULA O R D E R % 28.09.2026 CRL.M.A. 30484/2026 (for exemption) 1. Exemption is granted, subject to all just exceptions. 2. The Petitioner shall file legible and clearer copies of exempted documents, compliant with practice rules, before the next date of hearing. 3. Accordingly, the applications are disposed of. CRL.M.C. 7286/2026 4. The Petitioner seeks quashing of FIR No. 171/20181 registered at P.S. Neb Sarai under Section 448 of the Indian Penal Code, 1860.2 The principal contention of the Petitioner is that the impugned FIR arises out of a property dispute which had already led to registration of FIR No. 141/2017 under 1 “impugned FIR” 2 “IPC” This is a digitally signed order. The Order is downloaded from the DHC Server on 05/10/2026 at 11:47:07 Sections 420/506/120B IPC at the same Police Station, and essentially concerns the very same dispute. 5. At the outset, it is noted that the impugned FIR was registered in the year 2018 and the charge-sheet was filed in the year 2019, whereas the Petitioner has approached this Court only in the year 2026. There is, thus, considerable delay in raising the present challenge. At the same time, there is presently a lack of clarity as to the nature and scope of the allegations in the earlier FIR No. 141/2017 and their overlap, if any, with those forming the subject matter of the impugned FIR. The Court therefore considers it appropriate to call for a response from the State on this aspect before proceeding further. 6. Issue notice. Mr. Shoaib Haider, APP for State, accepts notice. 7. Status Report be filed before the next date of hearing. 8. Mr. Haider further informs the Court, on instructions from the IO, that Respondent No. 2/complainant has since expired. Let the particulars of her legal representatives be placed on record. Upon the same being furnished, notice be issued to the legal representatives of Respondent No. 2, by all permissible modes, returnable on 13th January, 2027.
