Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner seeking following reliefs :- AMITA DUBEY Digitally signed by AMITA DUBEY Date: 2026.06.05 14:20:57 +0530 2 10.1 That, the Hon’ble Court may kindly be pleased to allow this petition and the respondents may kindly be directed not to give an effect to the order dated 23.04.2026, 30.04.2026 and 15.05.2026 which related to the petitioner upto hearing of the petition filed by the petitioner before the Central Administrative Tribunal Jabalpur, in the interest of justice. 10.2 That, any other relief which this Hon’ble Court deems fit and proper may also kindly be granted to the petitioner in the interest of justice alongwith cost of the petition. 2. Learned counsel appearing for the petitioner submits that against the transfer order dated 23.04.2026 passed by respondents authorities, the petitioner has filed original application bearing Filing No. 1529 of 2026 before the Central Administrative Tribunal, Jabalpur (M.P.) {hereinafter referred to as “CAT, Jabalpur”) under Section 19 of the Central Administrative Tribunal Act, 1985 (henceforth, ‘Act, 1985’). However, since it is evident from the Notification dated 15.05.2026 (Annexure P-8) that the CAT, Jabalpur is on summer vacation with effect from 18.05.2026 to 12.06.2026, as such, urgent matters may be directed to be heard by the CAT Allahabad Bench as well as CAT Hyderabad Bench as per the Schedule of date given in the aforesaid Notification. He further submitted that the petitioner, being a woman, is unable to approach before the CAT Allahabad Bench and the CAT Hyderabad Bench as per the schedule provided in the aforementioned notification dated 15.05.2026. As such, she prayed that some interim protection be granted to her so that her case can be heard by the CAT Jabalpur itself after the summer vacation is over. Hence, instant petition has been filed seeking aforesaid relief. 3. On the other hand, learned counsel appearing for the respondents /Union of India, on advance copy, submits that according to the Notification dated 3 15.05.2026 (Annexure P-8), the petitioner is not required to be appeared personally before the CAT, Allahabad Bench as well as before the CAT Hyderabad Bench, she may appear through Video Conferencing also, as such, the grounds, which have been raised by the petitioner, is not maintainable, hence, interim protection may not be granted to the petitioner. In addition, it has been contended that the petitioner has already been relieved from her present place of posting on 12.05.2026, but she did not receive her relieving order till date, hence, no interim protection can be granted in favour of the petitioner. It has further been argued that transfers are made due to the exigencies of service, and no one can claim as a right to remain posted at a particular place. 4. I have heard learned counsel for the parties and perused the material available on record with utmost circumspection. 5. From the perusal of imputed transfer order dated 23.04.2026 (Annexure P-1), it appears that the petitioner has been transferred from ‘Chhattisgarh Circle’ to ‘Maharashtra Circle’, neither the place, where the petitioner has been transferred, is mentioned in said order nor any reason has been assigned in the said order for such transfer. Further, being aggrieved and dissatisfied with the aforesaid order, the petitioner has already preferred original application being Filing No. Filing No. 1529 of 2026 before the Central Administrative Tribunal, Jabalpur (M.P.), which is pending for consideration, however, due to summer vacation, CAT Jabalpur (M.P.) is not functioning, as such, according to the Notification, the petitioner has to approach before the CAT, Allahabad or the CAT, Hyderabad for redressal of her grievance. 6. According to the petitioner, at this stage, the petitioner, being a woman, is not able to approach concerned Advocates of CAT, Allahabad Bench or CAT, Hyderabad Bench and the matter of the petitioner has been listed before the CAT, Jabalpur on 16.06.2026. 4 7. As such, till 16.06.2026, purely as an interim measure, it is directed that effect & operation of the impugned transfer order dated 23.04.2026 (Annexure P-1) shall remain stayed in order to give an opportunity to the petitioner to place her case before the concerned Central Administrative Tribunal, Jabalpur. 8. It is made clear that this Court has not expressed any opinion on the merits of the case, rather this stay order is being passed only for the specific circumstance, under which, the CAT Jabalpur is not functioning due to summer vacation and as per Notification dated 15.05.2026, the petitioner is directed to approach before the CAT Allahabad Bench from 18.05.2026 to 31.05.2026 and thereafter from 01.06.2026 till 12.06.2026 before CAT Hyderabad Bench, as the matter of the petitioner is listed before the CAT Jabalpur on 16.06.2026. 9. With the aforesaid observation (s) and direction (s), the writ petition is disposed of. No cost (s). 10. Pending interlocutory application (s), if any, stands disposed of.
