The Court made the following: 3 THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM WRIT PETITION NO: 13983 of 2026 ORDER:- The instant writ petition has been filed by the petitioner under Article 226 of Constitution of India seeking the following main prayer: “….to issue a writ or direction more particularly in the nature of writ of mandamus declaring the action of the respondents 2 and 3 in laying the electrical wires under RDS works by fixing the angular on the electrical poles got erected by the petitioner’s firm on payment of costs as demanded by the respondents, affecting the power supply of 33 KV transformers, got erected for the purpose of consumption of petitioner’s factory, without any notice & intimation to the petitioner is illegal, arbitrary, highhanded, and violation of principles of natural justice and cannot be justified in the eye of law and consequently direct the respondents not to lay the electrical service wires through the electrical poles got erected by the petitioner for supply 33 KV Power supply to the transformer fixed in the petitioners business unit in Bhimavaram, West Godavari District in the interest of justice and pass.….” 2. The sum and substance of the writ petition is that the petitioner is aggrieved by the action of the respondent Corporation authorities in laying electric lines across the existing poles situated in the petitioner’s subject land. 3. When the matter is taken up for hearing, the learned counsel for the petitioner urged several grounds in the writ affidavit, however, restricting his prayer, he submits that the petitioner had already preferred a representation dated 25.04.2026 to the 3rd respondent and seeks disposal of the same in accordance with law. The learned Standing Counsel submitted that the 3rd respondent would pass appropriate orders in accordance with law. 4 4. In the light of the above facts and circumstances, and the submissions made by the respective counsel, with the consent of both counsel, the writ petition is disposed of with the following direction: The 3rd respondent is hereby directed to consider and pass appropriate orders on the petitioner’s representation dated 25.04.2026 (Ex.P3), after duly providing an opportunity of hearing to the petitioner, within a period of eight (08) weeks from the date of receipt of a copy of this order. Meanwhile, till disposal of the said representation, the respondents shall not take any coercive steps. 5. With the above direction, the writ petition is disposed of. There shall be no order as to costs.
