Present is a Contempt Petition filed by the petitioner under Section 12/15 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India alleging willful and deliberate disobedience of the order dated 17.06.2025 passed by this Court in W.P.(C) No. 2966/2025, whereby the respondents SUMIT KUMAR Digitally signed by SUMIT KUMAR Date: 2026.06.05 17:05:37 +0530 2 No.1 & 2 herein were directed to decide the application filed by the petitioner expeditiously as soon as possible, if there is no legal impediment. It is the case of the petitioner that despite having full knowledge of the aforesaid order, the respondents No. 1 & 2 have failed to comply with the directions issued by this Court. 3. Learned counsel for the petitioner submits that despite the order dated 17.06.2025 passed by this Court directing the respondent No. 1 & 2 to decide the application filed by the petitioner and proceed in accordance with law but no effective steps have been taken by the respondents for compliance thereof till date. It is further contended that the said order was duly brought to the notice of the concerned respondent authorities by communication dated 01.07.2025, which was acknowledged by the concerned office. The authorities have deliberately failed to act upon the directions issued by this Court. 4. Learned counsel for the petitioner further contended that such inaction amounts to willful and deliberate disobedience of the Court's order, particularly when a considerable period of time has elapsed without any progress in the matter. It is further contended that the failure of the respondent authorities to examine the validity of the caste certificate has enabled a private individual, allegedly not belonging to the Scheduled Tribe community, to continue enjoying the benefits flowing from the disputed certificate and to hold a public office reserved for Scheduled Tribes. 3 Therefore, learned counsel submits that the respondents have rendered themselves liable for contempt and prays for appropriate action in accordance with law. 5. I have heard learned counsel for the petitioner and perused the material annexed with the petition. 6. This contempt petition has been filed for non compliance of the order dated 17.06.2025 passed in W.P.(C) No. 2966/2025 by this Court. From perusal of the paragraph seven of the aforesaid order, it appears that the respondent No. 3 & 4 therein were directed to decide the application filed by the petitioner in respect of the application/complaint within expeditious period as soon as possible, if there is no any legal impediment. However, it is evident from the said order that no specific time frame was prescribed by this Court for disposal of the petitioner’s application/complaint. 7. Considering the aforesaid aspect of the matter, it appears from paragraph seven of the aforesaid order no time frame has been prescribed to decide the application/complaint of the petitioner. Therefore, in the interest of justice the petitioner is further directed to file afresh application/complaint/representation within a period of two weeks before the concerned respondent authorities and in- turn, the respondents herein are directed to consider and decide the application/complaint/representation and to decide the same within four months from the date of submission of representation 4 alongwith the copy of this order. It is made clear that the respondents are under obligation to decide the application/complaint/representation in accordance with the law by further taking into consideration that the earlier order was passed way back on 17.06.2025. 8. With the aforesaid observation and direction, the present petition is disposed of. 9. Pending Interlocutory Applications, if any, shall stand disposed of. Sd/- (Amitendra Kishore Prasad) JUDGE Sumit
