By way of this writ petition, the petitioners have prayed for following reliefs:- “i This Hon'ble Court may kindly be pleased to issue a appropriate writ, order, or direction to the respondents/Authorities to protect the fundamental right of the petitioners provided under Article 19 (1) (g) of the Constitutions of India; ii. This Hon'ble Court may kindly be pleased to issue a appropriate writ, order, or direction, restraining Respondent No. 8, its President, office-bearers, and agents from creating any hindrance, obstacle, or interference, directly or indirectly, in the peaceful conduct of the petitioners' transportation business through their trucks; iii. This Hon'ble Court may kindly be pleased to issue a to the appropriate writ, order. or direction Respondents/Authorities to provide protection to the petitioners, their staff, and their vehicles against any illegal use of physical force, coercion, threats, or 3 boycotts orchestrated by Respondent No. 8 or its members. iv. This Hon'ble Court may kindly be pleased to issue a appropriate writ, order, or direction to the Respondent Authorities to conduct an inquiry into the working and management of Respondent No. 8 and, if necessary, remove the Board of Directors/Office Bearers for abusing their powers and acting in open violation of the fundamental rights guaranteed under the Constitution of India. v. That, this Hon'ble Court may kindly be pleased to grant any such other relief in favor of petitioner as this Hon'ble Court may deem fit in the interest of Justice.” 3. Learned counsel for the petitioners at the outset submits that the grievance of the petitioners would be redressed, if the representation filed before the Collector, Uttar Bastar, Kanker and the representation filed before the Superintendent of Police, Bhanupratappur, will be directed to be decided by the concerned authorities, after giving due opportunity of hearing to the respective parties and for that purpose, a meeting can be conveyed, because, due to in-action on the part of the Parivahan Sangh, the livelihood of the petitioners is being effected, which is violation of Article 19 of the Constitution of India. 4. Considering the aforesaid submission made by learned Counsel the petitioners and considering further that there would be a violation of Article 19 of the Constitution of India, in case, the petitioners are not permitted to run their transporting business, the Collector, Uttar 4 Bastar Kanker (C.G.) as well as the Superintended of Police, Uttar Bastar Kanker (C.G.) are directed to consider the application, as filed by the petitioners way back on 29/05/2026, in accordance with law and if from perusal of the application, it appears that the respective persons, who are making hindrance in the transporting business of the petitioners, are also required to be heard, then, they may be also called and after giving them due opportunity of hearing, the concerned Collector shall resolve the matter in accordance with law, keeping in view that no person can be authorized to make hindrance in business of any other person under Article 19 of the Constitution of India. The concerned Collector is directed to consider and decide the aforesaid application within a period of 30 days from the date of production of copy of the same. 5. With the aforesaid observations and directions, the instant petition stands disposed of. 6. Pending interlocutory applications, if any, shall also stand disposed of.
