Judgment / Order 20/01/2026
1.
Learned counsel for the petitioners submits that, on his application, the agreement dated 16.04.2008, having been found insufficiently stamped, has not been sent to the Concerned Authority for proper stamping and has only been impounded by the learned Trial Court.
2. He apprehends that the document might be permitted to be exhibited during evidence without proper stamping.
3. Heard learned counsel for the petitioners and perused the material available on record.
4. The apprehension shown by the learned counsel for the petitioners is baseless as until and unless the document is properly stamped, the same is inadmissible in evidence under the Rajasthan Stamps Act, 1998.
5. Moreover, if the document has been impounded by the learned Trial Court, no exhibition in evidence is permissible until the document is properly stamped.
6. With the above observations, the present Civil Writ Petition stands disposed of.
7. Pending application(s), if any, also stand disposed of.
