For Petitioner : Mr.M.Vijayarathinam For Respondents : Mr.M.Sakthi Kumar Government Advocate(civil side) 1/6 https://www.mhc.tn.gov.in/judis W.P.Crl.(MD)No.2225 of 2026 ORDER Seeking to direct the respondents to consider the petitioner's complaint dated 12.06.2025 and take appropriate action against one Kannan and to recover the temple keys and pooja products from the said Kannan and hand over the same to the Trustee, this writ petition is filed. 2. The learned counsel for the petitioner submitted that the petitioner is the Heriditary Trustee of Sri Pon Irulappan Swamy Temple, Sri Vengadesvara Perumal Temple, Vadakkathi Amman Temple, Devarayanpatti, Virudhunagar District. Those temples are in existence for the past nearly 200 years. The petitioner's ancestors are the founders and trustees of the said temple. The petitioner had the possession of the lock and key of the of the temple and she was in the management of the said temple. However, one Kannan, who is the President of the village Panchayat had lodged a complaint before the respondent police as if the petitioner had failed to conduct the regular poojas and insisted on recovering the keys from her. On his instance, the 2nd respondent police had forcibly obtained the keys of the said temple from the petitioner and handed over the same to the petitioner said Kannan. However, he has no manner of right of administration in the said temple. It is a family temple of the petitioner. In this regard, the petitioner has given a complaint dated 2/6 https://www.mhc.tn.gov.in/judis W.P.Crl.(MD)No.2225 of 2026 12.06.2025 to the 1st respondent by registered post to recover the keys of the temple and pooja products. However, no action was taken. Hence this petition. 3. The learned Government Advocate (crl.side) submitted that the Peace Committee was conducted between the petitioner faction and the 4th respondent faction, in which they have resolved their disputes among themselves. It was all about the conduct of Kumbabishekam and now the Kumbabishekam is also over. On that premise, this petition is already closed. 4. Per contra, the learned counsel for the petitioner submitted that the submission made by the learned Government Advocate is partly correct and it is true that the Kumbabishekam was conducted at the instance of the petitioner. However, thereafter the temple keys were not handed over to her. At the instance of the 2nd respondent police, the temple keys have already been handed over to the Poosari and now the Poosari has colluded with the said Kannan and is refusing to give the keys back to the petitioner who is the Trustee of the aforesaid temple. They have together shifted all the pooja articles from the temple to the private residence as well. Heard the learned counsel on either side and carefully perused the materials available on record. 6. In view of the submission made by the petitioner, the 2nd respondent police is directed to reopen the petition and put the petitioner as well as the said Kannan on summons and if at all the submission made by the learned counsel for the petitioner with respect to the keys are concerned is true, the 2nd respondent police shall take necessary steps to restore the possession of the keys to the petitioner since she is the Trustee of the temple. 7. With the above directions, this Writ Petition stands disposed of.
