THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE M.I.ARUN ORAL ORDER Petitioners are said to be the Directors of respondent No.2-Society. Respondent No.4 is said to be the President of respondent No.2-Society. There is a dispute between the petitioners and respondent No.4 in respect of management of the affairs of the Society. On the allegation that respondent No.4 has misused his official position and has indulged in malfeasance and misfeasance and misappropriation of money, petitioners have - 4 - HC-KAR NC: 2026:KHC:28684 WP No. 16783 of 2026 requested respondent No.3-Bank not to honour the cheques signed by respondent No.4 and has further requested that no money should be allowed to be withdrawn by respondent No.4. They have also passed a resolution as to who has to operate the account. 2. The Joint Register of Co-operative Society has issued a communication dated 09.06.2026 to the respondent No.3-Bank, wherein he has briefly analysed the dispute and has directed the Bank as to who can operate the account of respondent No.2-Society which is with the Bank. The said communication is filed along with a memo dated 12.06.2026 by respondent No.3-Bank. 3. The petitioners, respondent No.2 and the State have no objections for the account of respondent No.2- Society be operated in terms of the communication dated 09.06.2026. Respondent No.3-Bank also has no objection for honouring the same. - 5 - HC-KAR NC: 2026:KHC:28684 WP No. 16783 of 2026 4. For the aforementioned reasons, writ petition is hereby allowed, respondent No.3 is directed to defreeze the account of respondent No.2-Society and will allow operation of the account of respondent No.2-Society with it in terms of the communication dated 09.06.2026 issued by the Joint Registrar of Co-operative Societies. 5. It is needless to state that the State is always at liberty to enquire into any misfeasance or malfeasance in the respondent No.2-Society and initiate suitable action in accordance with law.
