Case No.8530 of 2019 from Baruipur Court to the Court of learned Chief Judicial Magistrate, Bankshall Court, Kolkata on the ground that another case being FIR No. 2832 of 2019 corresponding to G.R. Case No.8529 of 2019 has already been transferred before that Court and both the matters are required to be heard conjointly in order to avoid conflict of judicial decisions. Learned Counsel appearing on behalf of opposite party submits that if the said prayer for transfer is allowed, his client has got no objection. 2 Having heard learned Counsel appearing on behalf of the petitioner and both the opposite parties, the prayer made by the petitioner is allowed. The G.R. Case No.8530 of 2019, presently pending before learned Additional Chief Judicial Magistrate-II, Baruipur Court arising out of Baruipur Police Station Case No.2834 of 2019 dated 11.12.2019 is hereby transferred from said Court to the Court of learned Chief Judicial Magistrate, Kolkata. Learned District Judge, South 24-Parganas is directed to withdraw the case record from the Court of learned Additional Chief Judicial Magistrate-II, Baruipur Court within a period of 3 weeks and to transmit the same to the Court of learned Chief Judicial Magistrate, Bankshall Court, Kolkata. Since no affidavit- in-opposition has been asked to be filed by the opposite party, the allegations levelled against the opposite party no.2 shall be treated as not admitted. Let a copy of this order be sent to learned District Judge, South 24-Parganas and learned Chief Judicial Magistrate, Bankshall Court, Kolkata. CRR 3970 of 2025 along with connected application, if any, stands disposed of accordingly.
