The CRP was dismissed and in view of adjudication of the issue in C.R.P.No.2676 of 2022, the petitioner seeking stay on execution proceedings would also not be considered as the learned single Judge while dismissing the CRP, had observed that the granting of stay on the appeal proceedings cannot be considered and granting of stay on the execution proceedings also cannot be allowed. Following the same, C.R.P. is closed. Considering the submission that the appeal suit is pending from the year 2019 onwards, though it was filed in the year 2017 along with an application seeking condonation of delay, the learned Judge may endeavour to dispose of the appeal within a period of four (4) weeks from the date of receipt of this order. Pending miscellaneous petitions, if any, shall stand closed. ____________________ JUSTICE HARINATH.N Date.23.02.2026 SR
