THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA CONTEMPT CASE NO: 4809/2024 ORDER:
Heard the learned counsel for the petitioners and the learned counsel for the respondents. 2. The present contempt case is filed alleging that even though this Court passed an order dated 12.04.2023 in W.P.No.6299 of 2023 directing the respondent Nos.2 and 3 to consider the representation of the petitioner dated 26.12.2022 and pass appropriate orders within a period of six weeks from the date of receipt of copy of the order, even after lapse of six weeks as directed, the respondents neither considered the representation and passed speaking orders nor appointed the petitioner as village surveyor Grade-III in Village Secretariat. Hence, the contempt case. 3. On the other hand, learned counsel for the respondents furnished written instructions dated 13.06.2023 stating that as directed by this Court the representation of the petitioner was disposed of within a period of six weeks from the date of receipt of copy of the order holding that the petitioner is not entitled for appointment as Grade-III surveyor. Therefore, the order of this Court is complied with in all respects and not committed any offence under Section 10 and 12 of the Contempt of Courts Act, 1971.
4. Heard both the learned counsel and perused the material placed on record. On perusal of the written instructions dated 13.06.2023 it is clear and categorical that the respondents passed a speaking order considering the
4
representation of the petitioner dated 26.12.2022. In view of the speaking order passed by the respondents, the order of this Court has been complied with in all respects. Hence, no further orders are necessary. 5. Accordingly, the contempt case is closed. However, if the petitioner has any grievance, he is at liberty to initiate appropriate proceedings, if necessary. No order as to costs. Consequently, Miscellaneous Petitions, if any, pending in the contempt case shall stand closed. ________________________________ VENKATESWARLU NIMMAGADDA, J
