INDIRESH ORAL ORDER In this petition, the petitioner is challenging the Endorsement dated 17th October, 2025 (Annexure-C) issued by the respondent No.3-Tahsildar and order dated 20th July, 2024 (Annexure-D) passed by the respondent No.2-Deputy Commissioner in respect of the subject land bearing Survey No.254 measuring 1 acre situate at H. Mogenahalli Village, Channapatna Taluk, Bengaluru South District. 2. Heard Sri. A. Nagarajappa, learned counsel appearing for the petitioner and Sri. Spoorthy Hegde N., - 3 - HC-KAR NC: 2026:KHC:27568 WP NO.1060 OF 2026 learned High Court Government Pleader appearing for respondents. 3. Having heard the learned counsel appearing for the parties and on careful consideration of the impugned order dated 20th July, 2024 (Annexure-D) passed by the respondent No.2-Deputy Commissioner, the same would indicate that the petitioner herein has filed application seeking regularisation of of the subject land and the said application came to be rejected on the ground that the son of the applicant was a retired Government servant. Taking into consideration the provision contained under Rule 108F of the Karnataka Land Revenue Rules, 1966, I am of the view that the reason assigned by the respondent-Authorities, rejecting the application made by the petitioner is incorrect. Therefore, the matter requires to be remitted back to the respondent-Authorities for consideration afresh. Accordingly, I pass the following: O R D E R (i) Writ Petition allowed; (ii) Order dated 20th July, 2024 (Annexure-D) passed by the respondent No.2, rejecting the application made by the petitioner in respect - 4 - HC-KAR NC: 2026:KHC:27568 WP NO.1060 OF 2026 of the subject land mentioned at Sl.No.4 of the Annexure-1 therein is hereby set-aside, consequently endorsement dated 17th October, 2025 (Annexure0C) by the respondent No.3 is quashed; (iii) The matter is remitted back to the respondent-Authorities to re-consider the issue afresh and take decision in the matter, after affording an opportunity of hearing to the petitioner in terms of provisions contained under the Karnataka Land Revenue Act and Rules thereunder.
