Order On Board 02/06/2026 1) Heard. 2) This writ petition under Articles 226 of the Constitution of India has been filed for the following relief(s) :- (i) That this Hon’ble Court may kindly be pleased to set aside of the impugned eviction notice dated set aside the entire revenue proceeding of revenue case no. 202602271300039/A-68/2025-26 pending before the respondent no.4 Tahsildar - Ramanujganj, Distt- Balrampur- Ramanujganj (C.G) ANNEXURE P/7. (ii) That, any other relief or reliefs may also be granted to the petitioner which this Hon'ble Court deems fit and proper in the facts and circumstances of the case. 3)
Learned Counsel for the Petitioner would submit that the Petitioner purchased a Nazul Plot No.523, area 42 Decimal, situated at Ramanujganj vide registered sale deed dated 24/11/2006 from Ramchandra Jain. Since the aforesaid land was wrongly mentioned in revenue map, therefore, the Petitioner filed an application before the Sub-Divisional Officer (Revenue), Ramanujganj under Section 115 of the Chhattisgarh Land Revenue Code Act, 1959, which is pending consideration before it. Despite that, Tehsildar issued a notice to the Petitioner under Section 248 of the Chhattisgarh Land Revenue

3 Petitioner in WPC No.2570/2026, in which, this Court vide order dated 15/05/2026 passed stay order in favour of the Petitioner, directing Respondent–Tahsildar, Ramanujganj to go on proceeding on said revenue case but shall not pass any final order, till the next date of hearing. Despite that Tahsildar, Ramanujganj passed final
order vide Annexure P-14 mentioning back date, i.e. on 12/05/2026. He further submits that on 14/05/2026, the Petitioner filed another application (Annexure P-15) before Tahsildar, Ramanujganj, which was taken by him. He further submits that if prior to that, impugned
order (Annexure P-14) would have been passed, then Tahsildar, Ramanujganj ought not to have taken that application on record. He further submit that the Petitioner has already challenged impugned
order dated 12/05/2026 (Annexure P-14) passed by Tahsildar, Ramanujganj by filing appeal (Annexure P-16) before Sub- Divisional Officer (Revenue), Ramanujganj, in which stay application has also been filed, but the same has not been decided yet. Despite that Tahsildar, Ramanujganj has issued impugned eviction notice (Annexure P-1) dated 15/05/2026 against Petitioner, hence he pray that this petition may be disposed of directing Sub- Divisional Officer (Revenue), Ramanujganj to decide his stay application (Annexure P- 17) dated 27/05/2026 and till then effect and operation of impugned eviction notice (Annexure P-1) dated 15/05/2026 may be stayed. 4)
Learned Counsel appearing for the Respondents/State would submit that there is no material to show that the order has been antedated. He further submits that impugned eviction order has been passed on 15/05/2026, i.e. on same date when stay order was passed by this

He further submits that the application filed by the Petitioner before the Sub- Divisional Officer (Revenue), Ramanujganj shall be decided in accordance with law. 5) Having considered totality of the facts of the case, particularly considering the fact that earlier Co-ordinate Bench of this Court has already passed stay order in favour of the Petitioner in WPC No.2570 of 2026 and further considering the fact that in light of Annexure P-15 dated 14/05/2026 Tahsildar, Ramanujganj has passed antedated order (Annexure P-14) i.e. on 12/05/2026, as contended by Counsel for the Petitioner and further considering the fact that the Petitioner has already filed an appeal (Krishna Gupta Vs. State of Chhattisgarh) Annexure P-16, challenging the final
order passed by the Tahsildar before the Sub- Divisional Officer (Revenue), Ramanujganj alongwith stay application (Annexure P- 17), this petition is disposed of directing Sub- Divisional Officer (Revenue), Ramanujganj to decide stay application (Annexure P-17) dated 27/05/2026 filed by the Petitioner as early as possible. Till then the effect and operation of the impugned order (Annexure P-1) dated 15/05/2026 passed by the Tahsildar, Ramanujganj shall remain stayed. 6) With the aforesaid observations, the petition stands disposed of at the motion stage itself. 7) Pending interlocutory applications, if any, shall also stand disposed of.
