Sinha, APP …...... 02/20.03.2026: This application has been filed by the son of the complainant to recall the order dated 07.05.2025 passed in ABA No. 6230 of 2024. 2. ABA No. 6230 of 2024 was filed by the accused in relation to a Complaint Case No. 625 of 2022 under Sections 307, 34, 120B, 323, 384, 406 and 420 of the Indian Penal Code. 3. In the complaint case after taking cognizance summons were issued. This Court in the order dated 07.05.2025 held that since the case arises out of a compliant and cognizance has been taken on the complaint based on materials available on the record, there is no question of custodial interrogation. The Court further held that when summons have been issued the petitioner should appear and file the surrender-cum-bail application before the court concerned and assure the Court that he will cooperate in the trial and not influence the witness. 4. Now the petitioner in this Cr.MP prays for recall of the order dated 07.05.2025 passed in ABA No. 6230 of 2024 on the ground that before the Mediator and DLSA, Deoghar the accused has accepted that he will pay the money. 2026:JHHC:7915 2 5. The aforesaid ground is not the legal ground for recall of the order dated 07.05.2025 passed in ABA No. 6230 of 2024. 6. Accordingly, this Cr.MP is dismissed.
