Case No.142 of 2026 dated 01.04.2026 under Sections 126(2)/117(2)/118(2) and 109 of the BNS, 2023. And In the matter of: Paritosh Tiwari … petitioner Mr. Ajit Kumar Mishra Mr. Jyotirmoy Jha Mr. Abhishek Dey … for the petitioner Mr. Krishnendu Bhattacharya … Amicus Learned counsel for the petitioner submits that the petitioner was the then election in-charge of the opposition political party for the Bally Assembly Constituency. He has been falsely implicated in this case. At the relevant time, he was not even at the place of occurrence. Actually, the alleged victim was drunk, fell down and injured himself. Learned Amicus, assisting the State, opposes the prayer for anticipatory bail and relies on the case diary, the statements of the victim and his relatives and the injury report which, however, does not show infliction of any grievous injury. He points to the statement of the person who used to look after the CCTV cameras at the building complex. According to his statement present at page 24 of the case diary, the CCTV cameras were not in working 2 condition and that is why no CCTV footage could be provided. Considering the above and the other materials available in the case diary, I am inclined to grant anticipatory bail to the petitioner. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner shall cooperate with the investigation, shall meet the investigating officer once a week till submission of report in final form and shall not threaten or intimidate witnesses. The application for anticipatory bail is, thus, allowed. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
