JUSTICE E.S.INDIRESH ORAL ORDER In this writ petition, the petitioner is assailing the eviction notice/order dated 05.04.2023 (Annexure-E) issued by the respondent - Tahsildar. 2. Sri H.C. Shivaramu, learned counsel appearing for the petitioner submits that the petitioner's application is pending consideration before the respondent authorities for a considerable period. However, without hearing the petitioner, the impugned notice has been issued to the petitioner. Accordingly, the petitioner has sought for quashing of the impugned notice at Annexure-E. - 3 - HC-KAR NC: 2026:KHC:27825 WP No. 8820 of 2023 3. Per contra, learned High Court Government Pleader sought to justify the impugned notice at Annexure-E. 4. In the light of the submission made by learned counsel appearing for the parties, it is forthcoming that no notice has been issued to the petitioner herein before issuing eviction notice/order. In that view of the matter, I am of the view that the said eviction notice/order at Annexure-E may be considered as a show cause notice to the petitioner and the petitioner is permitted to file objection to the said notice within a period of four weeks from the receipt of certified copy of this order and after receipt of such reply that may be made by the petitioner, same shall be considered by the respondent within three months thereafter. In the meanwhile, the respondent is directed not to evict the petitioner from the schedule property, till the consideration of the reply that may be made by the petitioners. In the meanwhile, it is open for - 4 - HC-KAR NC: 2026:KHC:27825 WP No. 8820 of 2023 the respondents to consider the application made by the petitioner in Form No. 57 at the earliest.
