Contents of the memo reads as under: “The petitioners in the above case submits that the petitioners agreed to pay impugned cheque amount of Rs.8,31,974/- with compensation 50% of the cheque amount Rs.4,15,987/- totally amount into 12,47,961/-. Out of the said amount a sum of Rs.4,16,500/- is deposited before the trial Court the balance sum of Rs.8,31,461/- the petitioners agreed to deposit the said amounts Rs.8,31,461/- within four weeks from today before the Trial Court. - 4 - HC-KAR NC: 2026:KHC:17641 CRL.RP No. 1189 of 2017 Wherefore the Hon’ble Court may be please to accept the memo in terms of the order passed by this Hon’ble Court in the interest of Justice and Equity” 3. Placing the memo on record, petition stands disposed of. 4. Amount in deposit is ordered to be withdrawn by the complainant under due identification if not already withdrawn. 5. It is made clear that if the balance compensation in a sum of Rs.8,31,461/- is not paid within four weeks as is agreed by the petitioners in the memo, petitioner Nos.2 and 3 shall undergo imprisonment as ordered by the Trial Magistrate, confirmed by the First Appellate Court. 6.
