Accused in SC No.41/2026 pending before the Court of III Additional District and Sessions Judge, Mysuru, arising out of Crime No.123/2025 registered by Biligere Police Station, Mysuru, for the offences punishable under Sections 103(1) and 238(a) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.123/2025 was registered by Biligere Police Station, Mysuru, against unknown persons for the aforesaid offences after the dead body of a lady known as Komala was found in a nearby park within the jurisdiction of Biligere Police Station, Mysuru. During the course of investigation of the said case, petitioner herein was arrested on 11.10.2025 and remanded to judicial custody. After completing investigation, charge sheet has been filed against him for the aforesaid offences. His bail application filed before the Trial Court was rejected on 13.03.2026. Therefore, he is before this Court. - 3 - HC-KAR NC: 2026:KHC:28677 CRL.P No. 5804 of 2026 4. FIR in the present case was registered against unknown persons after the dead body of deceased Komala, aged about 32 years, was found near a park within the jurisdiction of Biligere Police Station, Mysuru. Petitioner was arrested during the course of investigation and in the charge sheet, which is filed subsequently, it is alleged that petitioner had relationship with deceased Komala. It is further alleged that Komala had subsequently developed relationship with CW 18 - Chandru and after petitioner came to know about the same, he developed ill- will as against the deceased and decided to eliminate her. On 11.04.2025, petitioner allegedly took Komala along with him from KSRTC bus stand at Nanjanagudu and thereafter, committed her murder by strangulating her neck with a veil, which she was wearing. 5. The entire case of the prosecution is based on circumstantial evidence. Undisputedly, petitioner has no other criminal antecedents. Investigation of the case is completed and charge sheet has been filed. Charge sheet allegations are required to be proved in a full fledged trial against the petitioner. Trial in the case is yet to commence. Under the - 4 - HC-KAR NC: 2026:KHC:28677 CRL.P No. 5804 of 2026 circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following:- 6. The petition is allowed. The petitioner is directed to be enlarged on bail in SC No.41/2026 pending before the Court of III Additional District and Sessions Judge, Mysuru, arising out of Crime No.123/2025 registered by Biligere Police Station, Mysuru, for the offences punishable under Sections 103(1) and 238(a) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; - 5 - HC-KAR NC: 2026:KHC:28677 CRL.P No. 5804 of 2026 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
