Mr. Jewel Chanda Ms. Rumki Guha …for the Petitioner In this application the petitioner has prayed for a direction upon the court below for expeditious disposal of the Case being AC-873/2024 presently pending before learned 4th Judicial Magistrate, Alipore, South 24 Parganas. Being aggrieved by the inordinate delay caused in disposal of the petitioner’s application under section 23 of the Protection of Women from Domestic Violence Act, 2005 which was filed on 4th March, 2024, learned counsel for the petitioner submits that the matter was taken up on several occasions, however, the opposite parties repeatedly sought for adjournments and adopted dilatory tactics resulting in no effective progress in disposal of the said application filed under section 23 of the Act. Though petitioner concluded her submission before the trial court in respect of the said application but opposite parties are taking adjournments one after another and thereby delaying the disposal of the said application. Therefore, petitioner prayed for a necessary direction upon the court below for expeditious disposal of the said proceeding. 2 Having heard learned counsel for the petitioner, I find that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice and as such, the service of copy of application upon the opposite parties is hereby dispensed with. Having considered the submission made on behalf of the petitioner and that the application filed by the petitioner under section 23 of the Protection of Women from Domestic Violence Act, 2005 is pending for more than two years, I find that the prayer made by the petitioner is justified and is required to be allowed for securing the ends of justice. In view of the above, the instant application being CRR 1653 of 2026 is hereby disposed of with a direction upon the court below to dispose of the petitioner’s application under section 23 of the Protection of Women from Domestic Violence Act, 2005 preferably on the next date of hearing or within a period of four weeks thereafter. This order is passed invoking this court’s jurisdiction under section 529 of the BNS.
