A Contempt Petition under Sections 10/12 of the Contempt of Courts Act, 1973 has been filed for wilful disobedience of the maintenance Order dated 04.12.2025 in Complaint Case No. 26964/2018 under the Protection of Women from Domestic Violence Act, 2005. 2. It is submitted by the petitioner herself that an Appeal has been preferred by the respondent challenging the Order. Also, Execution Proceedings are being filed for execution of interim maintenance Order. 3. In these circumstances, once the Order itself is under challenge it cannot be said that there is contempt especially when the execution petition have also been filed. 4.
