The petitioners are apprehending their arrest in connection with Charhi P.S. Case No.118 of 2024, for offence registered under section 274, 275, 292, 3(5) of BNS, 2023 and Section 47(a), 52 and 55 of Excise Act, pending in court of learned Judicial Magistrate First Class, Hazaribagh.

Learned counsel for petitioners submits that the petitioners happened to be owners of Pick-up van and Hywa vehicle respectively and the allegations are made that 650 pieces of spirit jars each filled with 40 litres were loaded on the said vehicle. He further submits that the said vehicles were being driven by the drivers of the said vehicles and the petitioners have got no criminal antecedent as disclosed in paragraph no.13 of the petition.

4. Learned State counsel opposes prayer and submits that allegations are there of loading 650 pieces of spirit jars each filled with 40 litres on vehicle bearing registration No.BR31GB-6578 and on Hywa 150 gallon spirit were loaded.

Considering that the petitioners happened to be owners of Pick-up van and Hywa vehicle respectively and the said vehicles were being driven by the drivers, and in that view of the matter, both the petitioners are directed to surrender before learned court within two weeks from today and learned court shall release the petitioners, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper.
6. This petition is disposed of.
