The Criminal Petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, ‘BNSS’) by the petitioners/Accused, seeking to quash the proceedings against them in Crime No.38 of 2025 of Arundalpet Police Station, Guntur District, registered for the offences punishable under Sections 85, 115(2), 318(3), 351(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’), and Sections 3 and 4 of Dowry Prohibition Act, 1961 (for brevity ‘the D.P.Act’). 3 Dr. YLR, J Crl.P.No.4142 of 2026 Dated 07.05.2026 3. I.A.No.2 of 2026 is filed by the petitioner/respondent No.2/de-facto complainant seeking permission to permit the petitioner/respondent No.2/de- facto complainant to compromise the matter with respondents/accused and to compound the offences under Sections 85, 115(2), 318(3), 351(2) read with 3(5) of ‘the BNS’ and Sections 3 and 4 of ‘the D.P.Act’, in Crime No.38 of 2025 of Arundalpet Police Station, Guntur District. 4. I.A.No.3 of 2026 is filed by the petitioner/respondent No.2/de-facto complainant seeking to record compromise between the petitioner/respondent No.2/de-facto complainant and the respondents/accused as per the joint memo and quash the proceedings against the respondents/accused in Crime No.38 of 2025 of Arundalpet Police Station, Guntur District. 5. Today, when the matter was taken up for hearing, the petitioners/accused and respondent No.2/de-facto complainant were present before this Court. They produced their respective attested copies of Aadhar cards in proof of their identity, and the same were placed on record for proper identification. Both the learned counsel on record identified both the parties in open Court. 6. The learned counsel for the petitioners submits that the petitioners and respondent No.2 intend to compromise the disputes, and that petitioner No.1 and respondent No.2 have obtained divorce. 4 Dr. YLR, J Crl.P.No.4142 of 2026 Dated 07.05.2026 7. Ms. P. Akhila Naidu, learned Assistant Public Prosecutor for the State, and the learned counsel for respondent No.2, reported no objection for recording the compromise. 8. This Court enquired the respondent No.2/de-facto complainant about her willingness to enter into a compromise in the matter. She represented before the Court that she has voluntarily come forward for the compromise. The de-facto complainant further represented that the case may be closed against the accused persons and she does not want to prosecute the matter. 9. Considering the submissions and in the light of the judgment of the Hon’ble Apex Court in Gian Singh vs. State of Punjab and another1, since there is an amicable settlement between the parties, in the interest of justice, I.A.Nos.2 & 3 of 2026 are disposed of. 10. Consequently, the Criminal Petition is allowed, and the proceedings against the petitioners/Accused in Crime No.38 of 2025 on the file of Arundalpet Police Station, Guntur District, are hereby quashed.
