The application is disposed of. FAO 320/2026 1. By way of the present appeal filed under Section 30 of the Employees' Compensation Act, 1923, the appellant seeks to assail the order dated 01.12.2025 passed by the learned Commissioner, Labour Department, GNCT Delhi, South West District, DTC Colony, Pratap Nagar, Hari Nagar, New Delhi in EAR (I)- 29/DLC/SWD/2022/6907, whereby the claim application filed by the claimants/respondents came to be allowed. 2. The claimants had alleged that the deceased was employed as a driver on Truck bearing No. HP-64B-4739 and was earning Rs.15,000/- per month along with daily allowance of Rs.250/-. The learned Commissioner awarded compensation of Rs.8,80,575/- along with Rs.5,000/- towards funeral expenses and interest @ 12% per annum from 23.04.2021 till realization. 3. The only contention raised in the present appeal is that the learned Commissioner has not taken into account Notification No. S.O.1258(E) dated 31.05.2010, whereby the Central Government had specified Rs.8,000/- as the monthly wages. 4. The said contention, however, cannot be accepted in view of the stand taken by the appellant wherein they admitted to paying the deceased a sum of Rs.10,000/- per month, which is more than Rs.8000/- as claimed now. 5. In view of the aforesaid, this Court finds no ground to entertain the present appeal and the same is accordingly dismissed. 6. It is stated by learned counsel for the appellant that the entire amount stands deposited with the learned Commissioner. Let the said amount along with accrued interest be released to the respondents forthwith. 7. The appeal is disposed of in above terms. 8. Pending applications, if any, also stand disposed of.
