JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed seeking the following prayer. “Wherefore, the petitioner respectfully prays that this Hon’ble Court may be pleased to: a. Issue a writ of certiorari or any other appropriate writ, order, or direction quashing the impugned notice bearing Ref No. .¸ÀºÁAiÀÄPÀ PÁAiÀÄð¤ªÁðºÀPÀ EAf¤AiÀÄgï(«)/¸À.EA(vÁA)/25-26/ 223-24 dated 08.04.2026/16.04.2026 issued by respondent No.3 (Annexure-A); b. Issue a writ of mandamus directing the respondents not to disrupt, disconnect, or interfere with the electricity supply to Installation No.83986 pending final regularisation parameters by local municipal authorities and c. Pass any such other orders as this Hon’ble Court deems fit in the interest of justice and equity.” - 3 - HC-KAR NC: 2026:KHC:26900 WP No. 16378 of 2026 2. Learned Counsel for the petitioner submits that petitioner is the absolute owner of the property and is in possession of the property by virtue of registered Partition Deed executed amongst his father, brother and sister. It was a registered document. On 30.09.2023, the petitioner filed an application before the Mysuru City Corporation(MCC) seeking permission to safely demolish the pre-existing, dilapidated structure on the scheduled property. On 23.11.2023, the Mysuru City Corporation accorded sanction for the demolition of the old building. The petitioner demolished the structure and constructed a commercial Warehouse/godown on spanning a built-up area of 3,599.99 sq.ft. and the petitioner's name is mutated in the revenue records. Thereafter, on 20.07.2025 petitioner has submitted a formal application to respondent No.3 seeking an upgrade and enhancement of the entire electricity load from 0.4 KW to 24 KW under a commercial tariff to operationalize newly built warehouse. After technical verification and due scrutiny respondent No.3 sanctioned and regularised upgrated 24 KW commercial load by order dated 30.07.2025. On 11.11.2025 the old meter was formally and permanently surrendered to the respondents. A third party, - 4 - HC-KAR NC: 2026:KHC:26900 WP No. 16378 of 2026 who has no interest in the scheduled property, filed an RTI application on 06.01.2026, questioning the additional load sanction. On 06.04.2026, the vigilance squad of respondent No.2 conducted a sudden site inspection without prior notice or opportunity of hearing to the petitioner. Thereafter, the impugned notice dated 08.04.2026 is issued, giving a seven day ultimatum to produce the Occupancy Certificate or Completion Report, failing which electricity supply would be permanently disconnected. 3. Learned counsel appearing for the petitioner submits that the respondents without giving a reasonable opportunity are going to disconnect the power supply, which made him to come before this court. 4. Learned counsel Sri. Devraju.H.V, who takes notice on behalf of the respondents 1 to 3 on instructions submits that now they have issued a notice giving him 7 days time. If the petitioner gives his explanation to the said notice, considering the same, they will pass appropriate orders. Till such time, they will not disconnect the power supply subject to payment of regular consumption charges. - 5 - HC-KAR NC: 2026:KHC:26900 WP No. 16378 of 2026 5. Having heard the learned counsels on either side, perused the material on record. The petitioner has questioned the show cause notice and learned counsel appearing for the respondents submits that without passing a final order they are not going to disconnect the power connection subject to payment of the usage charges. In that view of the matter this court is passing the following: ORDER i. The writ petition is disposed of directing the respondents not to disconnect the power supply until a final order is passed pursuant to the impuned notice dated 08.04.2026. ii.
