(In A.B.A. No. 3997 of 2026) ------ 02/21.07.2026 Both the A.B.As. are arising out of the same FIR and in view of that both the A.B.As. have been heard together with consent of parties. Heard learned counsel for the petitioners and learned counsel for the State. 2. The petitioners are apprehending their arrest in connection with Kisko P.S. Case No.08 of 2025, registered for the offence under Sections 103(1), 85 and 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Lohardaga. 3. Learned counsel appearing for the petitioners submits that in A.B.A. No. 2516 of 2026, the petitioners are father-in-law and mother-in-law respectively of the deceased and the petitioner in A.B.A. No. 3997 of 2026 happens to be husband of the deceased. He next submits that the deceased has committed suicide by way of hanging herself and there are general and omnibus allegation against these petitioners. He further submits that in the post-mortem report which has come in the case diary, cause of death has been found to be Asphyxia due to hanging. He also submits that there is no 2026:JHHC:21493 2026:JHHC:21495 other injury on the body of deceased. On these grounds, he submits that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State opposes the prayer and submits that the death has occurred within seven years of marriage and there are allegation against the husband of mental torture. She also submits that the petitioners in A.B.A. No. 2516 of 2026 are father-in-law and mother-in-law. On these grounds, she submits that anticipatory bail may kindly be rejected. 5. On perusal of the FIR and further from the post-mortem report, it transpires that so far the father-in-law and mother-in-law in A.B.A. No. 2516 of 2026 are concerned, there are general and omnibus allegation against them and cause of death is said to be Asphyxia due to hanging and in view of that, I am inclined to grant anticipatory bail to the petitioners- Jagu Oraon and Bimla Oraon @ Bimla Oraiyn in A.B.A. No. 2516 of 2026. 6. Accordingly, the petitioners- Jagu Oraon and Bimla Oraon @ Bimla Oraiyn in A.B.A. No. 2516 of 2026 are directed to surrender before the learned court within two weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Lohardaga, in connection with Kisko P.S. Case No. 08 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 7. So far the petitioner- Amit Oraon in A.B.A. No. 3997 of 2026 is concerned, he is husband of the deceased and the allegations are made of mental torture upon the deceased by the husband and further the death has occurred within seven years of marriage, I am not inclined to grant bail to the petitioner- Amit Oraon in A.B.A. No. 3997 of 2026. 8.
