Mr. Bhavya Pratap Singh, learned counsel for the petitioner. 2. Mr. Ghanshayam Joshi, learned Additional Chief Standing Counsel for respondent no.1. 3. Ms. Ruchika Negi, learned counsel holding brief of Mr. Sandeep Kothari, learned counsel for the respondent no.2. 4. By the instant writ petition, the petitioner is praying for the following relief:- “(i) Issue a writ order or direction in the nature of mandamus directing the learned Trial Court (1st Additional Civil Judge (Junior Division) Haldwani) to expeditiously conclude the trial of Civil Suit No. 116 of 2024 within 3 months or within such period as deemed fit and proper by this Hon’ble Court in the interest of effective justice.” 5. The relief as sought appears to be innocuous. The petitioner herein preferred a suit for permanent injunction bearing Civil Suit No. 116 of 2024 in the Court of 1st Additional Civil Judge (Junior Division) Haldwani in which the respondent no.3 Mr. Chandan Singh Bisht is the defendant no.1 and sufficient time was given to the respondent no.3 to file the written statement, but every time he is seeking adjournment. 6. In such view of the matter, the instant writ petition is disposed of finally with the direction to the trial court to expedite Civil Suit No. 116 of 2024 titled as Smt. Surinder Kaur vs. Chandan Singh Bisht as expeditiously as possible preferably within four months from the date of production of certified copy of this order. 7. It is made clear that trial court shall not grant and unnecessary adjournment to the defendant no.1, who is the respondent no.3 herein. (Rakesh Thapliyal, J.) 06.04.2026 Nahid
