HON'BLE MR. JUSTICE ANAND SHARMA
Order 21/01/2026
1. Petitioner has filed this contempt petition alleging non- compliance of order dated 30.06.2025, whereby while disposing of the writ petition on limited prayer made by learned counsel for the petitioner, it was expected from the Board of Revenue (for short ’the Board’) to make all possible endeavors to decide the review petition expeditiously as early as possible preferably within a period of three months from the date of receipt of certified copy of this order.
2.
Learned counsel for the petitioner submits that copy of
order dated 30.06.2025 was placed before the Board on
[2026:RJ-JP:2573] (3 of 3) [CCP-1387/2025]
03.07.2025. Thereafter, although final arguments were heard and
judgment was reserved on 28.07.2025, yet the judgment was not pronounced and matter has been kept for re-hearing. As per the petitioner such adjournments granted by the Board comes within a purview of contempt petition.
3. Bare perusal of the order-sheets placed on record would reveal that after reserving the judgment, the matter has been released by Member of the Board vide order dated 25.08.2025 with the remark to list the matter before any of the Single Bench of Board.
4. Thus, it is clear that it is not a case where the directions given by this Court have been deliberately or willfully flouted by the Members of the Board. Hence, no case of the contempt is made out. However, the petitioner shall submit an application before Chairman of the Board along with the instant order as well as
order dated 30.06.2025 earlier passed by the Co-ordinate Bench with a prayer to dispose of the review petition at the earliest. The Chairman shall take necessary steps for early disposal of the review petition.
5. In view of above, the contempt petition is dismissed.
