...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased tomay be pleased to issue a writ order of direction more particularly one in the nature of Writ of Mandamus, declaring that the action of the Respondent No.2 in deleting the Petitioners land from the 1-B Khatha No.266, vide Rc.C/R.O.R/935/2025, dt 03-01-2026, the land admeasuring Ac. 0-16 cents in Sy.No.311-Al, situated at Pasupula Village and Grampanchayat, Kurnool Rural Mandal, Kurnool District, Andhra Pradesh and also trying to demolish the Compound wall and other buildings of the Petitioners Society, which is illegal, arbitrary and also violation of Article 21 and 300-A of the Constitution of India and also against Section 5 of the Andhra Pradesh Rights In Land And Pattadar Pass Books Act, 1971 and consequently, set aside the
Order Respondent/RDO, Rc.C/R.O.R/935/2025, dt 03-01-2026 and direct the Respondents not to demolish the compound wall and other structures of the Petitioners Society and pass such IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the Respondent Authorities not to demolish the compound wall and other structures of the Petitioner's Society, admeasuring Ac. 0-16 cents in Sy.No.311- Al, situated at Pasupula Village and Grampanchayat, Kurnool Rural Mandal, Kurnool District, Andhra Pradesh and pass Counsel for the Petitioner:

The Court made the following Order:
Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for Revenue appearing for the respondent Nos.1 to 3 and Mr. N. Hemanth, the learned counsel appearing for the 6th respondent.
2. The issuance of notice to the 5th respondent is dispensed with as no prejudice would cause to him even if it is disposed of in his absence.
3. This writ petition is filed questioning the order passed by the 2nd respondent dated 03.02.2026 ordering deletion of the excess land to an extent of Ac.0.16 cents out of Ac.4.07 cents recorded in the name of the petitioner herein under 1B Khata No.266 in Sy.No.311-A1 of Pasupula Village.
4. On the basis of the instructions of the 3rd respondent dated 05.05.2026, the learned Assistant Government Pleader for Revenue submits that pursuant to the orders of the 2nd respondent dated 03.02.2026, the 3rd respondent was
directed to carry out necessary mutation in favour of the unofficial respondent No.5 herein/the appellant/petitioner therein for the subject extent. Accordingly, the revenue records were mutated in favour of the 5th respondent herein. The respondent Nos.2 and 3 have not made any attempt till date to demolish the compound wall and the building of the petitioner’s society as alleged by the writ petitioner.

5. The learned counsel appearing for the 6th respondent also submits that further appeal is pending vide Rc.D5/167/2026 before the Joint Collector, Kurnool.

In view of the above said facts and circumstances, recording the said instructions of the 3rd respondent dated 05.05.2026 and the Collector and Magistrate, Kurnool dated 06.05.2026, no further orders are necessary in this writ petition. However, the petitioner is permitted to pursue the appeal filed before the Joint Collector, in accordance with law. The said written instructions of the 3rd respondent and the Collector and Magistrate, Kurnool shall be made as part of the Court record.
7. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
