The petitioners are apprehending their arrest in connection with Complaint Case No. 675 of 2021, registered for the offence under Section 438 of Jharkhand Municipal Council Act, 2011 pending in the Court of learned Chief Judicial Magistrate, Koderma. 3. Learned counsel appearing for the petitioners submits that the petitioners have not encroached any public land and false allegation has been made of encroaching public land. He submits that the petitioners have purchased the constructed house. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are thereof encroaching public land. 5. Considering the dispute with regard to encroachment of the public land and it was pointed out that the petitioners have purchased the constructed house, and in that view of the matter, the petitioners, named above, are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
