The present Second Appeal has been preferred by the plaintiffs under Section 100 of the Code of Civil Procedure, 1908, assailing the impugned judgment and decree dated 30.04.2025 passed by the learned First District Judge, Raigarh, District Raigarh (C.G.) in Civil Appeal No. 42/2023, affirming the judgment and decree dated 13.03.2023 passed by the learned Second Civil Judge Class-II, Kharsia, District Raigarh (C.G.), in Civil Suit No. 06-A/2020, whereby the civil appeal filed by the appellants/ plaintiffs was dismissed. 2. The parties have filed a compromise petition stating therein that during pendency of the present appeal, they have amicably settled the dispute in respect of the suit land and no dispute now survives between them with regard to the subject matter involved in the appeal. It has further been stated therein that the parties have entered into a compromise agreement dated 23/07/2025 3 and, in view of the said settlement, they do not wish to prosecute the present appeal any further and the same may be disposed of accordingly. The compromise petition/docket is duly filled in and signed by both the parties. 3. In view of the above, the present appeal is disposed of. 4. The Court fees, if any, be refunded, in accordance with the extant Rules. 5. The compromise sought for by the parties is permitted and the matter in hand stands disposed of. 6. A copy of the docket (compromise arrived at between the parties) be made part of this decree. 7. A decree be drawn accordingly.
