Rakesh Kainthla, Judge The petitioner has +led the present petition for quashing of FIR No.13 of 2026, dated 13.02.2026, registered at Police Station, Shimla (East), District Shimla, H.P., for the commission of o5ences punishable under Sections 281 and 125(a) of Bhartiya Nyaya Sanhita (BNS), 2023. 2 2026:HHC:36062 2. It has been asserted that the matter has been compromised between the petitioner and the informant. The informant does not want to proceed further with the matter after the compromise. Hence, the petition. 3. The statement of the informant was recorded on 22.06.2026, in which he stated that he had entered into a compromise with the accused voluntarily, without any in;uence from any person, and he had no objection to quashing the FIR based on a compromise between the parties. 4. I have heard learned counsel for the parties and have gone through the records carefully. 5. A perusal of the FIR shows that the petitioner was driving the vehicle bearing registration No. HP-63D-2088, which fell o5 the road, and the petitioner sustained injuries. This Court had quashed the FIR registered against the driver, who had fallen into the gorge and sustained injuries, in Pankaj Kumar Vs. State of HP 2020:HHC:1674 and Vikas Kumar Vs. State of H.P. 2026:HHC:6089 based on compromise. 6. The o5ence punishable under Sections 281 and 125 (a) of the BNS corresponds to Sections 279 and 337 of the IPC. 3 2026:HHC:36062 This Court has quashed the F.I.R. registered for the commission of o5ences punishable under Sections 279 and 337 of the IPC in Sushant vs State of H.P. 2023 HLJ 531, Vikas Huda vs. State of H.P. 2023 STPL 3009, Kulvinder Singh vs Ankush Kumar 2023 HLR 384 and Nishant vs. State 2022 Suppl. Shim Law Cases 45, based on compromise. 7. In view of these binding precedents, the present petition is allowed, and the FIR No.13 of 2026, dated 13.02.2026, registered at Police Station, Shimla (East), District Shimla, H.P., for the commission of o5ences punishable under Sections 281 and 125(a) of BNS and the consequential proceedings pending/initiated against the petitioner-accused in pursuance thereof are ordered to be quashed. 8. Petition stands disposed of in the above terms, so also pending miscellaneous applications, if any. 9.
