The Petitioner in W.P.No.11841/2026 is before this Court seeking for the following reliefs: 1. Set aside the communication dated 27.02.2024 bearing number KaiE/Javali/VappaA/Anumodane Samithi-7/2023-24/2009 issued by the 2nd Respondent vide Annexure-A 2. Issue a writ in the nature of Mandamus or any other writ or order or direction directing the 2nd respondent to consider the representation dated 02.03.2026 furnished by the petitioner vide Annexure-V and forthwith release the entire subsidy amount. 3. Pass such other order/s as this Hon’ble Court deems fit in the interest of justice and equity. 2. The Petitioner in W.P.No.11429/2026 is before this Court seeking for the following reliefs: 1. Set aside the communication dated 27.02.2024 bearing number KaiE/Javali/VappaA/Anumodane Samithi-7/2023-24/2009 issued by the 2nd Respondent vide Annexure-A 2. Issue a writ in the nature of Mandamus or any other writ or order or direction directing the 2nd respondent to consider the representation dated 02.03.2026 furnished by the petitioner vide Annexure-V and forthwith release the entire subsidy amount. 3. Pass such other order/s as this Hon’ble Court deems fit in the interest of justice and equity. 3. The grievance of the Petitioners is that the impugned order at Annexure-A, cancelling the project approval - 5 - HC-KAR NC: 2026:KHC:28071 WP No. 11841 of 2026 C/W WP No. 11429 of 2026 and the subsidy has been made without even issuing a notice to the Petitioners. 4. Learned AGA is unable to place any such notice on record. 5. Therefore, it appears that the impugned orders have been passed without notice being issued to the Petitioners and resulting in violation of the principles of natural justice. 6. In that view of the matter, this Court passes the following: ORDER i) The Writ Petitions are partly allowed. ii) The communications/orders dated 27.02.2024 at Annexure-A issued by Respondent No.2 in both the petitions are read down as a show cause notice with liberty to the Petitioners to reply to the same within a period of two weeks from the date of receipt of a copy of this order. iii) The Respondents are directed to pass orders on the said reply within a period of four weeks from the date of receipt of the copy of the reply/objections to be filed by the Petitioners.
