JUSTICE ANIL KUMAR UPMAN Order 09/01/2026 1. This bail application under Section 483 of BNSS has been filed on behalf of the petitioner, who has been arrested in connection with FIR No.219/2022 registered at Police Station Mahaveer Nagar, District Kota City (Raj.) for offences punishable under Sections 420, 406 & 120B of IPC. After completion of investigation, police filed charge-sheet in this matter for offences punishable under Sections 420, 406, 120B, 467, 468 & 471 of IPC and Sections 3, 4, 5 & 6 of The Prize Chits and Money Circulation Schemes (Banning) Act, 1978. 2. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Counsel submits that alleged offences are triable by Magistrate. Counsel submits that though, 115 other cases have been registered against the petitioner but on [2026:RJ-JP:976] (2 of 3) [CRLMB-16879/2025] the basis of same allegations levelled by the different persons, these cases have been registered. Counsel submits that initially petitioner was taken into custody in the year 2022 and since then he is in custody. Counsel submits that in the present FIR, petitioner was taken into custody in the month of September, 2024. Counsel submits that in some cases, he has been granted benefit of bail by this Court and in one case, he has been granted benefit of bail by the Hon’ble Supreme Court. It is submitted that trial will take considerable time in its conclusion. It is also submitted that petitioner is patient of HIV. Further custody of the petitioner would not serve any fruitful purpose. 3. Learned Public Prosecutor opposes the bail application. He submits that 115 other cases have been registered against the petitioner. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the parties, especially the fact that alleged offences are triable by Magistrate; charge-sheet has been filed in this matter and trial will take considerable time in its conclusion as well as looking to the period of custody, but without commenting anything on the merits/demerits of the case, I deem it fit and proper to allow this bail application. 6. The bail application is accordingly allowed and it is directed that accused-petitioner- Murli Manohar s/o Badri Lal shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh only) together with two [2026:RJ-JP:976] (3 of 3) [CRLMB-16879/2025] sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned Trial Court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 7. Considering the criminal antecedents of the petitioner, it is made clear that the petitioner shall not involve in similar offence(s) during currency of bail granted by this Court. After being released from prison, he shall mark his presence in the concerned police station in first week of every month, till trial is concluded. 8. Concerned SHO shall enter the attendance of the petitioner in the Roznamcha. In case the petitioner fails to mark his presence in the concerned police station, as directed above, the concerned SHO is directed to immediately report the matter to the concerned Court in this regard. 9. If breach of any of these conditions is reported or come to the notice of the Court, the same shall alone be a reason for the trial Court to cancel the bail granted to petitioner by this Court. 10. Office is directed to send copy of this order to the concerned SHO for necessary compliance. 11. The observation made hereinabove is only for decision of the instant bail application and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J LALIT MOHAN /154
