None appears for the State, Panchayat Samiti and the private respondent despite service. The petitioner claims to be the recorded owner of the plot in question and alleges that the Block Development Officer and the Panchayat Samiti have constructed several shop rooms and converted the plot into a market complex. They have been leasing out the shop rooms to several persons. Several representations submitted by the petitioner in this regard before the concerned authority have not been heeded to. The petitioner seeks a direction upon the District Magistrate, Paschim Medinipur to take necessary steps in this regard. Upon consideration of the submission made on behalf of the parties, this Court directs District Magistrate, Paschim Medinipur, being the 4th 2 respondent herein, to consider and dispose of the representation submitted by the petitioner dated 1st September, 2023 within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondents, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. Pending disposal of the representation, no further construction or allotment of existing shop rooms shall be made by the concerned authorities. The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
