ORAL ORDER
1. In this Writ Petition, petitioner is assailing the order dated 16.12.2023 (Annexure-A), passed by respondent No.1 in R.P. No.203/2022, inter alia, challenging the
order dated 07.12.2021 passed by respondent No.2 in No. R.A(A):449/2021 (Annexure-B), and consequently seeking restoration of the revenue records in the name of the petitioner as per M.R.No.4/2020-21. 2. Sri. Vijaya Kumar K., learned counsel appearing for the petitioner, invited the attention of the Court to the registered Sale Deed dated 05.07.2006, wherein the petitioner had purchased the schedule property from one Sri. M. Gurappa and pursuant to the same, the jurisdictional Special Tahsildar, Anekal Taluk has entered the name of the petitioner in M.R.No.4/2020-21 and further submitted that the same was erroneously interfered with by the respondent - authority by the impugned order at Annexures - 'A and B', which requires to be set aside by this Court. - 4 -

It is also argued by the learned counsel appearing for the petitioner by referring to the proceedings before this Court in RSA No.713/2014 that rights of the parties would be decided in the said proceedings and therefore, sought for interference of this Court. Learned counsel also submitted that the petitioner, in terms of the order on I.A.1/2014 dated 21.08.2025 in RSA No.713/2014 passed by this Court, undertakes not to create any third party right in the schedule property in question. 4. Sri. N. Devaraju, learned counsel appearing for the respondent No.5 submitted that respondent No.5 had purchased the schedule property much prior to the petitioner herein and therefore, sought for dismissal of the Writ Petition. 5. Sri. H.C. Shivaramu, learned counsel appearing for the respondent No.4, sought to justify the change in entry in the revenue records as this Court is yet to consider the rights of the parties in terms of the Judgment and Decree that may be passed in RSA No.713/2014. 6. Learned Additional Government Advocate sought to justify the impugned order and sought for dismissal of the Writ Petition. - 5 -

7. In the light of the submissions made by the learned counsel appearing for the parties, it is not in dispute that entry in M.R.No.4/2020-21 is entered by the Tahsildar based on the registered Sale Deed dated 05.07.2006. 8.
In that view of the matter, as mutation has been made pursuant to the execution of the registered Sale Deed and rights of the parties is yet to be adjudicated in RSA No.713/2014, I am of the view that, both the authorities have committed an error in interfering with the mutation made in favour of the petitioner in M.R.No.4/2020-21, pursuant to the execution of the registered Sale Deed. 9. In that view of the matter, awaiting rights of the parties to be decided in terms of the Judgment and Decree that may be passed by this Court in RSA No.713/2014, entry in M.R.No.4/2020-21 shall stand restored in the name of the petitioner, which shall be subject to the final outcome in the
Judgment and Decree in RSA No.713/2014. It is also made clear that, as per the submission made by the learned counsel, petitioner shall not create any third party right in the property

in question, till the conclusion of proceedings in RSA No.713/2014.
10. With the above observation, the Writ Petition stands
disposed of.
11. Pending I.A.2/2025 is disposed of as not surviving for
consideration.
