The petitioners are apprehending their arrest in connection with Barkagaon P.S. Case No.133 of 2021 for the alleged offences registered under Sections 147, 148, 149, 307, 323, 341, 342, 337, 338, 435, 332, 333, 353, 427, 269, 270, 290 and 511 of Indian Penal Code, Section 2, 3 and 4 of Jharkhand State Epidemic Disease (Covid-19) Regulations, 2020 and Section 51 of National Disaster Management Act pending in the Court of learned ACJM, Hazaribag. 3. Learned counsel appearing for the petitioners submits that the petitioners have earlier moved before this Court in ABA No.7122 of 2021 and they were granted anticipatory bail by a Co-ordinate Bench of this Court with a condition to deposit a sum of Rs.10,000/- each as an interim victim compensation. He further submits that thereafter the petitioners 2026:JHHC:21510 --2-- A.B.A. No. 3356 of 2026 have also filed Cr.M.P. No.619 of 2023 for modification of the said order, however, the said was dismissed by the order dated 28.07.2023 by a Co- ordinate Bench of this Court. He then submits that in changed circumstances the present anticipatory bail application has been filed as the other co-accused persons have been granted anticipatory bail. 4. Learned counsel appearing for the State submits that even the modification of the said order has been rejected by a Co-ordinate Bench of this Court and in view of that this anticipatory bail application is not maintainable. 5. Admittedly, the petitioners have earlier moved before this Court in ABA No.7122 of 2021 and the petitioners were granted anticipatory bail. The petitioners have also filed Cr.M.P. for modification of the said order which was further dismissed by order dated 28.07.2023 and in view of that this anticipatory bail application is not maintainable. If the petitioners are still aggrieved by the order of the anticipatory bail, the remedy is not the second anticipatory bail application that is elsewhere. 6. In the attending facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioners, hence, the prayer for anticipatory bail of the petitioners is hereby rejected.
