Although complaining illegal construction and inaction on the part of the municipal authorities to arrest illegal construction at premises No. 11/1 East Topsia Road, Ward No. 66, Kolkata 700046, the instant writ petition has been filed, learned advocate for the petitioners would submit that the petitioners do not want to proceed with the writ petition. 2. The learned advocate for the municipality would submit that she is yet to receive instructions in the matter. 3. Since the petitioners seek to withdraw the writ petition, let the same be dismissed as withdrawn. 4. Dismissal of the writ petition shall not impinge upon the rights of the municipality to take appropriate steps in the matter as regard the complaint made by the petitioners as the matter concerns illegal construction.
