1. It is pointed out that First Appeal No.939/2022 was
disposed of on merit by the judgment dated 15.10.2025. During the pendency of the said appeal, the respondent no.1 was expired on 21.5.2025. However, this fact was not brought to the notice of this court while deciding the first appeal.
2. It is stated that in view of the judgment of this court and the fact that the respondent no.1 is expired on 21.5.2025, the prayer is made to apportion the share of respondent no.1 in between the remaining respondent nos.2 and 3, who are legal heirs of respondent no.1.
3. It is further stated that the respondent nos.2 and 3 have attended the majority, therefore, their share which was granted by this court can be released in their favour. To substantiate this submission, the applicant has relied upon the copy of Adhar Card of respondent no.2 and 3 on record.
4. For the reasons stated in the application, the application is allowed. The Nazar of this Court is directed to apportion the share of respondent no.1 in favour of respondent
2 05 CAF 2529.26.odt nos.2 and 3 and deposit the same in favour of respondent nos.2 and 3 in their separate account. The respondent nos.2 and 3, being attended the major age, they may be permitted to withdraw the amount which is awarded by this court.
5. The application stands disposed of.
