[2026:RJ-JP:4973] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 20205/2025 Rajesh Kumar Meena S/o Late Shri Kanhaiya Lal Meena, Aged About 29 Years, Resident Of Heerapura, Ramnagar, Jaipur (Raj). ----Petitioner Versus 1. State Of Rajasthan, Through The Principal Secretary, Education Department, Government Of Rajasthan, Secretariat, Jaipur, Rajasthan. 2. Director, Secondary Education, Rajasthan, Bikaner. 3. District Education Officer, Headquarter, Secondary, District Jaipur Rural. 4. Chief Block Education Officer, Kotkhavda, Jaipur. 5. Principal, Government Higher Secondary School, Khedaraniwas, Kotkhavda, Jaipur. ----Respondents For Petitioner(s) : Mr. Rakesh Swami For Respondent(s) : HON'BLE MR. JUSTICE ANAND SHARMA Order 03/02/2026 1. Petitioner has filed this writ petition for seeking compassionate appointment in place of his deceased father Shri Kanhaiya Lal Meena, who was appointed on the post of Teacher in Education Department in the year 1991, however, he died on 13.11.2024 while in service. As father of the petitioner was sole bread earner of the family, the petitioner submitted an application for seeking compassionate appointment under the Rajasthan Compassionate Appointment of Dependents of Deceased [2026:RJ-JP:4973] (2 of 2) [CW-20205/2025] Government Servant Rules, 1996 (hereinafter to be referred as 'the Rules of 1996'). 2. Learned counsel for the petitioner submits that only on the ground that elder brother of the petitioner Mr. Mukesh Kumar Meena has been appointed as Teacher Grade-III in the year 2017, the application filed by the petitioner for seeking compassionate appointment has not been entertained by the respondents. Learned counsel submits that his elder brother was not appointed on compassionate grounds, and rather he was appointed after undergoing the selection process and after appointment, he is maintaining his nuclear family separately, and is not taking care of other members of the family. 3. Heard learned counsel for the petitioner and perused the record. 4. Rule 5 of the Rules of 1996 is quite clear, where in the cases, in which any other member of the family, if already employed on regular basis under Central/State Government, then compassionate appointment cannot be granted to any other member of the family. 5. This Court finds that action of the respondents is strictly in accordance with the Rules of 1996. Hence, there is no ground to interfere in the instant writ petition, and the same is hereby dismissed. 6. Pending application(s), if any, also stand(s), disposed of. (ANAND SHARMA),J DIVYA /34
