That this Honble Court may kindly be pleased to issue appropriate writ of Mandamus or any other appropriate writ, order or direction, directing the respondent ,The chief municipal officer nagar Palika kanker to forthwith take all necessary steps for the thorough cleaning, maintenance, and ensuring proper drainage of the stagnant drain infront of House no 145 , Ekta nagar Uday nagar ward no 2 kanker, within a strict time bound manner. 2. That this Hon ble Court may kindly be pleased to direct the respondent to implement a regular and effective maintenance schedule for the said drain to prevent future stagnation and ensure hygienic conditions. 3. That the Hon'ble court may kindly be pleased to direct the respondent to provide a proper functional water exit and connectivity for the said drain to the main drainage system. 4.That this Hon'ble Court may kindly be pleased to award cost of this petition to the Petitioner. 5.That the Hon'ble court Pass any other or further orders as this Hon'ble court may be deemed fit and proper in the facts and circumstances of the case, in the interest of justice." 2. Learned counsel for the petitioner submits that respondent No.3 has utterly failed to comply its duty particularly with regard to maintenance of drainage- line in front of house of the petitioner. 3. Learned State counsel submits that for redressal of such grievances, a Permanent Lok Adalat has been established in Jagdalpur and petitioner may approach before it and raise his grievances. 4. The instant writ petition has been filed by the petitioner for a grievance regarding Respondent No.3’s failure and dereliction in maintaining proper drainage in front of the petitioner's house in Kanker etc. However, since the Permanent Lok Adalat (Public Utility Services) at Jagdalpur provides an 3 efficacious alternative remedy for such issues, this Court is not inclined to exercise its extraordinary jurisdiction under Article 226 of the Constitution of India. The petitioner is at liberty to approach the said forum for redressal. 5. Accordingly, this writ petition is disposed of reserving liberty in favour of the petitioner to raise his grievance before the aforesaid Permanent Lok Adalat (PUS) Jagdalpur.
