JUSTICE SANJAY KUMAR DWIVEDI For the Petitioners : Mr. Sabyasanchi, Advocate For the State : Mr. Shree Prakash Jha, A.P.P. ------ 02/18.07.2026 After some argument, learned counsel appearing on behalf of the petitioners seeks permission to withdraw this application with respect to petitioner nos.1 and 2 with liberty to move before the learned court to file regular bail application. 2. Learned counsel appearing for the State has got no objection. 3. Accordingly, this application is dismissed as withdrawn with respect to petitioner no.1- Munna Ram and petitioner no.2- Krishna Ram @ Ram Krishna @ Ram Krishna Ram with the aforesaid liberty. 4. Heard learned counsel for the petitioner nos.3 to 7 and learned counsel for the State. 5. The petitioner nos.3 to 7 are apprehending their arrest in connection with Bhawnathpur P.S. Case No. 52 of 2026, registered for the 2026:JHHC:21204 offence under Sections 126(2), 115(2), 118(1), 117(2), 109, 303(2), 333, 351(2), 352, 351(3) and 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Nagar Untari, Garhwa. 6. Learned counsel appearing for the petitioners submits that there are general and omnibus allegation of assault against all the petitioners. He further submits that there are case and counter case between the parties and the altercation took place while grocery items were being transported. He also submits that the petitioners are having no criminal antecedent as disclosed in para 14 of the petition. 7. Learned counsel appearing for the State opposes the prayer and submits that the allegation of assault are there and pursuant to that grievous injury has been received by the informant. On these grounds, he submits that anticipatory bail may kindly be rejected. 8. Considering that there are general and omnibus allegation against the petitioner nos.3 to 7 and allegation of assault are there against petitioner nos.1 and 2 and there are case and counter case between the parties and they are having no criminal antecedent as disclosed in para 14 of the petition, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner nos.3 to 7. 9. Accordingly, the petitioner nos.3 to 7 are directed to surrender before the learned court within two weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Nagar Untari, Garhwa, in connection with Bhawnathpur P.S.
