INDIRESH ORAL ORDER In this petition, the petitioner is seeking for direction to the respondents 1 to 3 to issue Saguvali Chit in favour the petitioner and put in possession in respect of the subject land situate at Mahantalingapura Village, Jigani Hobli, Anekal Taluk, Bengaluru District in terms of the order dated 18th April, 2012 (Annexure-G) passed by the respondent No.2-Deputy Commissioner. - 3 - HC-KAR NC: 2026:KHC:27176 WP NO.26040 OF 2024 2. Heard Smt. Keerthana Swamy, learned counsel on behalf of Sri. Karumbaiah T.A., appearing for the petitioner; Sri. Spoorthy Hegde N., learned High Court Government Pleader appearing for respondents 1 to 3; and Sri. M.S. Prakash, learned counsel appearing for the respondent No.4. 3. Smt. Keerthana Swamy, learned counsel appearing for the petitioner contended that, there is no impediment for respondents 1 to 3 to grant or issue Saguvali Chit to the petitioner in respect of the subject land in terms of the order dated 18th April, 2012 (Annexure-G) passed by the respondent No.2. Therefore, she sought for interference of this Court. 4. Per contra, Sri. Spoorthy Hegde N., learned High Court Government Pleader appearing for respondents 1 to 3 refers to the Notification bearing No.S.O.1036(E) dated 11th March, 2020 issued by the Ministry of Environment, Forest and Climate Change and submitted that the subject land claimed by the petitioner comes under Eco-Sensitive Zone of Bannerghatta National Park along with Geo-Coordinates. Having heard the learned counsel appearing for the parties, it is not in dispute that the respondent No.2 passed order dated 18th April, 2012 (Annexure-G), granting the subject land in favour of the petitioner. However, taking into consideration the Notification bearing No.S.O.1036(E) dated 11th March, 2020 issued by the Ministry of Environment, Forest and Climate Change, I am of the view that, no interference be called for in this petition as the subject land claimed by the petitioner falls under the Eco-Sensitive Zone of Bannerghatta National Park along with Geo-Coordinates as per the Notification.
