3. The prosecution case is that, petitioner no.1 is the husband and other petitioners are in-laws of the victim. Petitioner No.1 and the victim got married with each-other on 21st December 2015. After the marriage, the victim went to cohabit in the family of the petitioners. It is alleged that, between 21st November 2021 and 2nd March 2022, all the petitioners subjected the victim to cruelty to fulfill their unlawful demand of Rs.25,00,000/-. They used to taunt her that she was not good-looking. There are allegations of misbehaving against the father-in-law. It is alleged that when the victim complained about the same, the other petitioners assaulted her. Petitioner No.1. pressurized her to give him a divorce. Therefore, the aforesaid crime came to be registered. On completion of the investigation, the charge-sheet came to be filed.
4. The learned Counsel for the parties state that, now, the matter is amicably settled between the parties. Petitioner No.1 and the victim have decided to dissolve their marriage and they have also filed a Petition for the said relief. The petitioner No.1 has agreed to pay a sum of Rs.10,00,000/- to the victim towards full and final settlement. Therefore, the victim does not want to prosecute the petitioners in the aforesaid crime and, she has consented and given her no objection to quash the impugned FIR and the consequent proceedings. Mr.Chilap, learned Advocate tendered an Affidavit sworn by the victim along with copy of consent terms filed in Marriage Petition. It is taken on record and marked “X” and “X-1” respectively.
5. The victim is present before the Court. She is identified by
learned Counsel Mr.Chilap. She has reiterated the contents of the Affidavit. She states that she has no grievance against the p. 3 H.C.SHIV 35.WP2578.22.DOC petitioners. Therefore, she has given her consent and no objection to quash and set aside the said FIR and the proceedings in the said case. She is firm on her stand. Therefore, no purpose would be served by continuing the prosecution arising out of the said FIR and the consequent case. As a result, I am inclined to allow the petition.
6. As I expressed my opinion for quashing of the present crime, learned Advocates for the petitioners and the victim, on instructions submitted that, petitioner No.1 will voluntarily pay a cost of Rs.30,000/-and the victim will voluntarily pay a cost of Rs.20,000/-. Said statements are accepted as an undertaking given to this Court. Hence, following order:- (a) Criminal Writ Petition No.2578 of 2022 is allowed.
