JUSTICE B M SHYAM PRASAD ORAL ORDER The petitioner has invoked this Court's jurisdiction for directions to the respondents not to take coercive measures against the standing structure in the immovable property bearing No.1, Municipal Katha Old No.802, New No.27, Ramamurthy Nagar, Banaswadi Main Road, Kowdenahalli Dhakle, K. R. Puram, Bengaluru [the subject property]. The petitioner relies upon a set of photographs to contend that the respondents are taking action employing machines to demolish a standing structure with no notice. This Court, upon hearing Mr. N. S. Sheshadri, the learned counsel for the petitioner on the previous - 4 - HC-KAR NC: 2026:KHC:25894 WP No. 15739 of 2026 hearing date viz., 01.06.2026, has called upon Mr. Pawan Kumar, the learned Standing counsel for the second to fourth respondents, to secure instructions on the possibilities of demolition of a standing structure in the subject property. Mr. Pawan Kumar, on instructions, submits as follows. [a] The officers with the Bengaluru City East Corporation [with the Storm Water Drain Department] are only clearing the drains opening the slab constructed to cover the drain and there is no immediate threat to the standing structure in the subject property. [b] The jurisdictional Assistant Director of Land Records office has filed a Report stating, amongst others, that the petitioner has put up construction encroaching a Rajakaluve. - 5 - HC-KAR NC: 2026:KHC:25894 WP No. 15739 of 2026 [c] The Authorities propose to act upon this Report under law after issuing due notice. 4. Mr. Bopanna Belliappa, the learned Additional Government Advocate, who appears on behalf of the first respondent, is heard in the light of these submissions. This Court must opine that the fact that there is no immediate threat to the structure must suffice for the disposal of the petition, but without prejudice to the Authorities to act if the petitioner has encroached any public utility including a Rajakaluve.
