Criminal Miscellaneous Application No. 668/2025 Murari Lal Meena Son Of Shri Ramhet Meena, Resident Of Village Post Dalpura, Tehsil Nadouti, District Karauli. ----Petitioner Versus Central Bureau Of Investigation, Jaipur, Through Special Public Prosecutor. ----Respondent For Applicant(s) : Mr. Jag Mohan Saxena, Spl. PP for CBI with Mr. Chinmay Saxena, Adv. & Mr. Adityavardhan Pancholi, Adv. For Non-Applicant(s) : Mr. Bajran Lal Choudhary, Adv.
HON'BLE MR. JUSTICE ANAND SHARMA
Order 11/02/2026
1. This Criminal Miscellaneous Application has been filed on behalf of Central Bureau of Investigation for recalling order dated 13.11.2025, whereby directions were given to transfer all the pending cases against the petitioner for trial before Special Courts (CBI Cases) No.5, Jaipur Metropolitan-I, Jaipur.
2.
Learned counsel for the applicant submits that the
order has been passed on the basis of consent given by counsel for the CBI, whereas no instructions whatsoever were given by the CBI to the counsel to make any such concession. Learned counsel for the applicant further submits that the material fact that all the cases were distributed to the different courts in accordance with administrative directions given by Registrar (Rules) of this Court vide order dated 30.09.2020 was not disclosed by the petitioner at the time of making a request for transferring the cases to one
[2026:RJ-JP:6396] (2 of 2) [CRLMA-668/2025] court. Learned counsel has placed copy of order dated 30.09.2020 for perusal of this Court, which is taken on record.
3.
Learned counsel for non-applicant opposes the application and submits that as the order was passed on the basis of consent of earlier counsel for CBI, therefore, it cannot be recalled moreso when there is no provision in criminal jurisdiction for recalling any order passed on merits.
4. Heard learned counsel for the parties and perused the record.
5. It reflects from bare perusal of order dated 13.11.2025 that no decision on merits was given to decide the criminal miscellaneous petition and merely on concession given by learned counsel for the CBI, the order was passed. It has also not been disputed by learned counsel for the non-applicant that earlier looking to the large number of cases, distribution of the cases was made in compliance of order dated 30.09.2020 earlier passed by Registrar (Rules) of this Court.
6. It is settled proposition of law that where, even in the criminal matters, even if final order has been passed upon incorrect statement and unauthorized concession made by the counsels, the order can be recalled.
7. In the light of above, the Criminal Miscellaneous Application is allowed and order dated 13.11.2025 is hereby recalled. S.B. Criminal Miscellaneous (Petition) No.6283/2025 is restored at its original number and shall be listed for arguments before the roster bench on 18.02.2026.
