PINCODE 521111. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased tomay be pleased to issue an appropriate writ order or direction more in the nature of Writ of Mandamus declaring (I). declaring the impugned Endorsement dated 21-04-2026 issued by the 3rd Respondent on Application No. ELR20251126115 and the impugned Endorsement dated 16-06-2025 issued by the 3rd Respondent closing PGRS Application No.ELR202506161827 (No. 129/2025), in so far as they arbitrarily hold that the deficit extent of Ac. 0-12 cents in Re-Survey No. 155 of Polasanipalli Village, Nuzividu Mandal, Eluru District falls within the permissible survey allowance without resolving the discrepancy between the FMB and LPM records and the boundary dispute with the 6th Respondent, as being illegal, arbitrary, contrary to the statutory records, violative of the petitioner's rights under the AP Rights in Land and Pattadar Pass Books Act, 1971 and the A.P. Survey and Boundaries Act, 1923, and (ii). consequently direct the Respondents 2 to 5 to conduct a fresh comprehensive survey of R.S. No. 155 of Polasanipalli Village, Nuzividu Mandal, Eluru District, using sophisticated Rover equipment in the presence of ail boundary holders including the 6th Respondent, reconcile the FMB and LPM records, determine and demarcate the full and true extent of Ac. 10-03 cents as reflected in the petitioners Pattadar Passbook No. 6314170291 (Patta No. 291), and take appropriate action in accordance with law and pass such IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased Counsel for the Petitioner: 1. GP FOR REVENUE 3 BKM,J W.P.No.12844 of 2026 The Court made the following Order: Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondent Nos.1 to 5. 2. The issuance of notice to the 6th respondent is dispensed with as no prejudice would cause to him even if it is disposed of in his absence. 3. This writ petition is filed questioning the endorsement issued by the 3rd respondent dated 21.04.2026 in the matter of recording the extents of the possession of the land as detailed therein. 4. The learned counsel for the petitioner submits that pursuant to the complaint made through PGRS for conducting of survey for the subject lands, the survey was conducted and accordingly, the endorsement was issued by the 3rd respondent. In fact, the extent of possession of the land is shown less than the extent of the land mentioned in the documents of the petitioner. 5. On the other hand, the learned Assistant Government Pleader for Revenue appearing for the respondent Nos.1 to 5 submits that if the petitioner makes fresh F-line application through online, the same would be considered by the respondent Nos.4 and 5, following the due procedure. 6. In view of the above said facts and circumstances, the petitioner is permitted to make fresh F-line application, following the due procedure, by enclosing all the necessary documents in support of his claim within a period of two (02) weeks from the date of receipt of this order. On receipt of such 4 BKM,J W.P.No.12844 of 2026 F-line application from the petitioner duly, the respondent Nos.4 and 5 are directed to consider and dispose of the same, strictly in accordance with law, by hearing all the parties concerned, including the petitioner and the 6th respondent, giving due opportunity, by conducting of survey, upon verification of the records and the subject land, appropriate decision shall be taken on its own merits as expeditiously as possible, preferably within a period of two (02) months thereafter. 7. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
