1. GP FOR PANCHAYAT RAJ RURAL DEV
2. RAMA RAO KOCHIRI
3. NIMMAGADDA VIJAYA SANTHI The Court made the following common order:
Since the issues involved in these two writ petitions are interconnected, the writ petitions are disposed of by way of a common order. 2. The petitioner filed W.P.No.28391 of 2025 challenging the action of the 3rd respondent in permitting the 4th respondent to run the canteen without calling for tenders and considering the petitioner’s request to continue him since he is the existing licensee, pending disposal of W.P.No.15659 of 2025, is illegal and arbitrary. 3. The petitioner also filed W.P.No.15659 of 2025 impugning the notice dated 10.04.2025, cancelling the tender floated on 09.03.2025 for running the

mess and for supply of stationery at the Extension Training Centre-3rd respondent, is illegal and arbitrary. 4. The writ petitions were listed on 19.01.2026.
This Court heard Sri K.Jyothi Prasad, learned counsel for the petitioner(s) and Smt. Nimmagadda Vijaya Santhi, learned counsel appearing for the 3rd respondent. Both the learned advocates argued on merits for some time. During the course of arguments, learned counsel appearing for the 3rd respondent submitted that due to the pendency of W.P.No.15659 of 2025, the institution could not issue a fresh tender notification. Learned counsel for the petitioner would submit that if a fresh tender notification is issued, petitioner will not press the writ petition. In view of the same, this Court adjourned the writ petitions to today. 5. Today, when the matter is taken up, learned counsel appearing for the 3rd respondent submitted written instructions issued by the Principal, Extension Training Centre, Samalkot. The operative portion of the written instructions is extracted hereunder:
“11. Accordingly, the Extension Training Centre (Regional), Samalkot undertakes to issue a fresh tender notification within two (2) weeks, strictly following due procedure including wide publicity, reasonable time for submission of bids, adherence to eligibility conditions, transparent opening of bids, and selection based on fair competition and institutional financial prudence. The institution reiterates that the tender process shall be conducted strictly in accordance with applicable Government tender rules and procurement norms.”
4 SRS, J W.P.Nos.28391 & 15659 of 2025
6. Sri K. Jyothi Prasad, learned counsel for the petitioner(s) would submit that since the 3rd respondent is intending to issue a fresh tender notification, the petitioner is not pressing W.P.No.15659 of 2025, and the same is recorded. Accordingly, W.P.No.15659 of 2025 is closed. 7. In so far as the relief in W.P.No.28391 of 2025 is concerned, learned counsel would contend that though the petitioner is the existing contractor, the Principal, Extension Training Centre, entrusted the running of the canteen to the 4th respondent without considering the petitioner’s case. The learned counsel would further contend that since the Principal has undertaken to issue a fresh tender notification, the petitioner is not pressing the claim at this point of time.
He would pray to give liberty to the petitioner to initiate a writ petition afresh in case, if the respondent dodges the tender process. 8. Recording the same, W.P.No.28391 of 2025 is also closed, granting liberty to the petitioner as prayed for. It is not out of place to mention here that the petitioner is also entitled to participate in the fresh tender(s) to be floated by the 3rd respondent in accordance with the rules invogue. 10. Accordingly, the Writ Petitions are closed. No order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed. ___________________________ JUSTICE SUBBA REDDY SATTI Date: 21.01.2026 BSK
