IN THE HIGH COURT OF HIMACHAL PRADESH SHIMLA
CWP No. 14938 of 2026.
Decided on : 27
th August, 2026
Ishwender ...Petitioner.
Versus State of H.P. & Ors. ....Respondents. Coram: The Hon’ble Mr. Justice Ajay Mohan Goel, Judge. Whether approved for reporting?1 For the Petitioner: Mr. Vivek Singh Attri, Advocate. For the respondents: Mr. Anup Rattan, Advocate General with Mr. Pushpinder Jaswal, Additional Advocate General. Mr. Rahul Thakur, Advocate, vice Mr. Dhananjay Sharma, Advocate.
Ajay Mohan Goel, Judge (Oral). By way of this writ petition, the petitioner has, inter alia, prayed for following relief:
“i) to kindly allow the present petition and the order dated 22.08.2026 passed by the respondent authorities as contained in Annexure P-III, may kindly be quashed and set aside. ”
2. The contention of the learned counsel for the petitioner that the transfer is on the basis of a D.O. note of the Chairman of the Waqf Board, who also happens to be a Sub-Contractor, does not satisfy the Court for the reason that had it been a case that the petitioner had not completed his normal tenure at the said station, 1 Whether reporters of the local papers may be allowed to see the judgment?
2 then the Court would have gone into this issue. But in light of the fact that the petitioner has, in fact, stayed at the present station from July 2021 to August 2026, the Court sees no reason to interfere with the transfer order. Accordingly, the writ petition is dismissed. Pending miscellaneous application(s), if any, also stand disposed of accordingly.
(Ajay Mohan Goel) Judge 27th August, 2026.
