1. The petitioner has filed this petition seeking following relief (s) :
“10.1 The Hon'ble Court may kindly be pleased to call for the record pertaining to the case of petitioner. 10.2 The Hon'ble Court may kindly be pleased to direct the respondent no. 2 and 4 to proceed the petitioner's case for renewal
-2- of nazul patta in accordance with law and scheme/notification of the state government. 10.3 The Hon'ble Court may kindly be pleased to direct the respondents to do not interfere the possession of the petitioner situated at government nazul land at College Road Jashpurnagar District Jashpur bearing nazul land no. 367/1 (Ka) at about 5600 sqft., which is only shop of his livelihood, till the final decision of the proceeding of renewal of nazul patta. 10.4 That, the Hon'ble Court may kindly be pleased to grant any other relief, as if may deem fit and appropriate. 10.5 Cost of the petition may also be given.”

Mr. Sinha, learned counsel appearing for the petitioner would submit that the petitioner is a landless and old person, who is in possession of Nazul Land bearing Survey No.367/1(d) admeasuring 5600 sq.ft. situated at College Road, Jashpurnagar, District Jashpur (C.G.) since decades. He would further submit that initially, lease deed was granted in favour of the petitioner in the year 1970-71 and subsequently, an application was moved for renewal before the District Collector on 27.12.2001. He would contend that till date, said application has not been decided though the petitioner is still in possession of the subject property. He would further contend that the interim order was passed in favour of the petitioner on 18.06.2021. He would submit that a direction may be issued to respondent No.2 to decide the pending application of the petitioner for grant of lease deed expeditiously within stipulated time. 3. On the other hand, Mr. Pandey, learned Government Advocate appearing for the State would oppose the submissions. He would
3 submit that the petitioner has no right to retain the Government property. He would further submit that though a lease deed was granted in favour of the petitioner but he failed to apply for its renewal and therefore, his application has not been considered. He would contend that this petition deserves to be dismissed. 4. Heard the learned counsel appearing for the parties and perused the documents placed on record. 5.
Perusal of the documents and pleadings made in writ petition would show that the lease deed was granted in favour of the petitioner in the year 1971 and the petitioner moved an application for its renewal before the District Collector on 27.12.2001 but till date, said application has not been decided, therefore, without expressing any opinion on the merits of the case, this petition is
disposed of with a direction to the concerned Collector to decide pending application for renewal of lease deed expeditiously preferably within a period of 60 days from the date of receipt of a copy of this order.
6. With the aforesaid observation(s)/direction(s), the present petition is disposed of.
7. The interim order granted earlier in favour of the petitioner dated 18.06.2021 shall remain operative for a period of 60 days.
